Powerline Financial Services Agreement & Disclosure, Cont’d

In case of errors or questions about your electronic transfers, call us at 440-233-4878 or write us at Edco Federal Credit Union, 1165 North Ridge Road E, Lorain, Ohio 44055 as soon as possible, if you think your statement or receipt is wrong or if you believe that your password has been lost or stolen. We will need the following information:

*Your name and account number.

*Clear description of the error or the transfer you are unsure about, including date of the transaction.

*The dollar amount of the transaction.

If you tell us the information orally, we may require you to send us your complaint or question in written form within ten (10 ) business days.

We will inform you of the results of our investigation within ten (10) business days (ten (10) business days for point-of-sale transactions) after we hear from you and we will correct any error promptly. If we need more time, however, we may take up to forty-five 45 days to investigate your complaint or question (ninety (90) days for point-of-sale transactions). If we decide to do this, we will recredit your account within ten (10) business days (20 business days for point-of-sale transactions) for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within ten (10) business days, we may not recredit your account.

If we decide that there was no error, we will send you a written explanation within three (3) business days after we finish our investigation. You have the right to request copies of the documents that we used in our investigation.

Your rights under the Electronic Funds Transfer Act are more fully described in the Credit Union’s Electronic Funds Transfer Act Disclosure. Please review this document in conjunction with your use of our online financial services.

OUR LIABILITY FOR FAILURE TO MAKE TRANSFERS

If we do not complete a transfer to or from your account on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages. However, there are some exceptions. We will not be liable, for instance:

*If, through no fault of ours, you do not have enough money in your account to make the transfer.

*If the automated teller machine where you are making the transfer does not have enough cash.

*If the terminal was not working properly and you knew about the breakdown when you started the transfer.

*If circumstances beyond our control (such as flood or fire) prevent the transfer, despite reasonable precautions we have taken.

*There may be other exceptions stated in our agreement with you

CHANGES IN TERMS AND AGREEMENTS

For any reason and at any time Edco may alter, change, or otherwise create new policies concerning the terms of this agreement. You will receive notice of changes in the manner that is required by law or under the terms of this agreement. Unless otherwise provided by law, or unless no notice is required, you will receive notice of changes within thirty (30) days of the effective date of the change. If you have elected to receive notices and disclosures electronically and to the extent permitted by law we will supply you with such notices via E-mail or alert you to the availability of such notices on our web site. Continued use of our online financial service following the effective date of any changes to the terms of this agreement indicates your acceptance of any change in terms to the agreement.

TERMINATION

Your Edco Powerline services will remain in effect until terminated by you or us. You may notify us to cancel your Powerline Service at any time via mail, E-mail, calling or writing to us. This cancellation applies only to your Powerline Service and does not terminate your other accounts with us.

We reserve the right to terminate this Agreement and your access to the service at any time. You may terminate this service by providing written notice via E-mail, regular mail or hand delivered notice at any time. If there is a joint account holder on your account who has access to this service, joint account holders must provide separate written notice. We will terminate your service upon receipt of written notice by you within three (3) business days of our receipt of your written instruction to cancel the service. Any outstanding fees incurred in connection with this service remain your responsibility following termination.
